The key threshold issue is which court has jurisdiction over the subject matter and person.

County Small Claims Court in Florida will entertain legal actions to settle disputes up to $5,000 in value, excluding cost, interest, and attorneys fees. If the value of the dispute is between $5,000 and $15,000 the County Civil Court has jurisdiction. For all matters beyond $15,000 the 6th Judicial Circuit Civil Court is the venue.

Federal court involves a federal question which gives the United States District Court for the Middle District of Florida exclusive jurisdiction for such cases in the Tampa area. However, the federal court will also exercise jurisdiction over cases in which the parties are from different states and the claim or controversy is valued at greater than $75,000.00. State courts generally hear matters arising under state law and cases in which the federal court does not otherwise have jurisdiction.
